Elon Musk to keep lawsuit against OpenAI despite nonprofit control statement: Lawyer

Elon Musk plans to move forward with his high-profile lawsuit against OpenAI, his lawyer Marc Toberoff said Monday, just hours after the AI startup reversed course on an earlier plan to remove control from its nonprofit arm.

Under OpenAI’s newly proposed governance structure, its nonprofit parent would retain control over the for-profit business and become a major shareholder.

Musk, a co-founder of OpenAI, filed the lawsuit in March seeking to block the company’s shift away from nonprofit oversight, among other claims. A jury trial is scheduled for March 2026.
